    On changes to dredging and port infrastructure legislation

    - Despite the existing regulatory framework, implementation of new projects reveals certain problems... Rosmorrechflot and investors are currently working towards amending the Rules for Management of Dredged Material approved by the Government in 2015. The amendments would let use and store the material extracted during dredging.. 

    Besides, the Ministry of Transport and Rosmorrechflot have implemented a number of initiatives towards improvement of rulemaking related to both dredging and construction of seaports in general...

    Amendments to Article 48 of the Urban Development Code came into effect on 14 August 2018. With the new amendments, the list of technically challenging and highly dangerous facilities now includes only hydraulic engineering structures (not the ports as a whole – Ed.)… 

    The Ministry of Transport is currently preparing a legislative initiative on introducing amendments to Article 8 of the Federal Law on Seaports providing for regulation of legal relations in respect of building infrastructure facilities of seaports located on rivers… The draft law has been submitted by the Ministry of Transport to the Government...

    In view of the fact that a large number of investment projects on development of port infrastructure facilities are focused on creation of coal terminal, I cannot but settle on activities aimed at regulatory improvements in respect of this infrastructure. This work is being performed in pursuance of presidential instructions on minimization of negative impact on the environment in ports handling coal. In May 2018, RF Government included coal transshipment to the sphere of application of the best available technologies. Basing on it, the Ministry of Industry and Trade Federal, Marine and River Transport Agency and a group of investors involved in the related projects conducted certain work on introduction of amendments into the BAT reference book “Reduction of pollution discharges in the course of storage and safekeeping of goods and cargoes”... We expect it to be submitted to the Government in the nearest future.

    One more legislative initiative … relates to introduction of amendments to Article 65 of the Water Code … supposed to lift the ban on storing agricultural chemicals within water protective zones if they are located within ports’ borders. …The draft law has already been submitted to the Government... 

    Another project was initiated by the Ministry of Transport in pursuance of the instruction given by Yury Trutnev, Deputy Prime Minister of the Russian Federation - Presidential Plenipotentiary Envoy to the Far Eastern Federal District, on assigning a legal status to declarations of intent to invest in port infrastructure… 

    The last thing I would like to mention is updating of technical regulation documents related to designing and operation of seaport infrastructure facilities. Back in 2015, Rosmorport ordered the development of new rules and regulations related to designing of sea canals, fairways, maneuvering areas, technological designing of ports and technical operation of infrastructure facilities. Two of the document have already been developed and approved. … The last one is expected to come into effect by the end of 2019.
