    BP снизили штраф за ЧП в Мексиканском заливе

    Компания BP добилась соглашения с правительством США о сокращении штрафа на $3,4 млрд за загрязнение окружающей среды в Мексиканском заливе после аварии 2010 года на буровой платформе, передает Bloomberg.

    Судебные власти США согласились не учитывать несколько сотен тысяч баррелей нефти собранных компанией, прежде чем нефть начала поступать в воды залива, что важно при расчете суммы штрафа.
     
    По данным правительства США, в апреле 2010 года около 4,9 млн баррелей нефти хлынули из скважины Макондо у побережья Луизианы. BP удалось установить насосы прямо на поврежденную скважину и откачать на поверхность 810 тыс. баррелей нефти.

    Судья окружного суда в Новом Орлеане Карл Барбье заявил в своем вчерашнем постановлении, что «США и BP договорились, что 810,000 баррелей собранной нефти не должны учитываться при расчете суммы штрафа».

    В соответствии с законом США о чистой воде, виновник загрязнения обязан заплатить штраф в размере от $1100 до $4300 за каждый баррель пролитой нефти. Сумма штрафа зависит от целого ряда факторов, в том числе явилась ли авария следствием грубой небрежности или беспечности виновной стороны.

    Соглашение снижает максимальный штраф по гражданскому иску к ВР с $21 млрд до $ 17,6 млрд, в зависимости от того, будет ли признана BP в суде, который начинается на следующей неделе, виновной в халатности .

    Слушания в суде (без суда присяжных) по определению ответственности  BP за разлив нефти назначены на 25 февраля. Отдельные слушания будут проведены в августе, чтобы определить объем разлива нефти и оценить усилия самой компании при ликвидации аварии.

    Накануне ВР заявила в своем пресс-релизе, что компания намерена защищаться в суде, после неудачной попытки достичь соглашения с федеральным правительством и отдельными штатами. Компания заявила о своем несогласии с обвинениями в грубой беспечности.

    В ноябре BP достигла соглашения с Департаментом юстиции США по всем уголовным обвинениям, имеющим отношение к аварии в Мексиканском заливе. Это соглашение о признании вины BP включает выплату $ 4 млрд в качестве уголовного наказания и а также $ 525 млн за введение в заблуждение о масштабах разлива нефти.
