    Правительство РФ внесло изменения в порядок распределения общих допустимых уловов водных биоресурсов (документ)

    Правительство РФ постановлением от 16 февраля 2017 года №199 внесло изменения в Положение о распределении общих допустимых уловов водных биологических ресурсов применительно к видам квот их добычи (вылова). Виды квот, применительно к которым распределяются общие допустимые уловы водных биологических ресурсов, дополнены квотами на инвестиционные цели. Об этом сообщает пресс-служба правительства России.

    Проект документа внесен Минсельхозом России.

    Федеральным законом от 3 июля 2016 года №349-ФЗ внесены изменения в Федеральный закон от 20 декабря 2004 года №166-ФЗ «О рыболовстве и сохранении водных биологических ресурсов» в части совершенствования распределения квот добычи (вылова) водных биологических ресурсов (квоты).

    В частности, этим законом был введен новый вид квот – квоты, предоставленные на инвестиционные цели в области рыболовства для промышленного и (или) прибрежного рыболовства (квоты на инвестиционные цели).

    Также законом предусматривается, что с 1 января 2018 года квоты для промышленного рыболовства на континентальном шельфе и в исключительной экономической зоне Российской Федерации и квоты для прибрежного рыболовства во внутренних морских водах, в территориальном море, на континентальном шельфе и в исключительной экономической зоне Российской Федерации будут заменены квотами для промышленного рыболовства и (или) прибрежного рыболовства в морских водах. В связи с указанными законодательными изменениями подписанным постановлением внесены соответствующие изменения в Положение о распределении общих допустимых уловов водных биологических ресурсов применительно к видам квот их добычи (вылова) (утверждено постановлением правительства от 15 декабря 2005 года №768).

    Виды квот, применительно к которым распределяются общие допустимые уловы водных биологических ресурсов, дополнены квотами на инвестиционные цели. Скорректированы названия квот для промышленного и (или) прибрежного рыболовства в морских водах.

    При этом общий допустимый улов водных биологических ресурсов, определяемый применительно к квотам на инвестиционные цели, не должен превышать 20% общих допустимых уловов таких водных биологических ресурсов, распределяемых применительно к квоте для промышленного или для прибрежного рыболовства в морских водах или квоте, предоставленной Российской Федерации в районах действия международных договоров в области рыболовства, в зависимости от видов водных биологических ресурсов в определенных районах их добычи (вылова).

    Кроме того, уточняется круг лиц, которые могут осуществлять рыболовство в учебных и культурно-просветительских целях и в целях аквакультуры (рыбоводства). Теперь рыболовством в учебных и культурно-просветительских целях могут заниматься образовательные учреждения, научные организации или организации культуры, рыболовством в целях аквакультуры (рыбоводства) – индивидуальные предприниматели и юридические лица (в предыдущей редакции – граждане и юридические лица).
