    Капитан рыболовецкого судна привлечен к административной ответственности за неповиновение требованию руководства морского порта Туапсе

    По постановлению транспортного прокурора капитан рыболовецкого судна привлечен к административной ответственности за неповиновение законному требованию руководства морского порта Туапсе (Краснодарский край), сообщает пресс-служба Южной транспортной прокуратуры.

    Туапсинская транспортная прокуратура провела проверку соблюдения требований законодательства при осуществлении производства по делам об административных правонарушениях, рассмотренных должностными лицами Сочинского линейного отдела Южного управления государственного морского и речного надзора Федеральной службы по надзору в сфере транспорта.

    В ходе проверки материала о совершении капитаном маломерного рыболовецкого судна «Сейс -1» административного правонарушения, предусмотренного ч. 1 ст. 11.8 КоАП РФ (управление судном, имеющим неисправности, с которыми запрещена его эксплуатация), выявлен факт совершения им другого правонарушения.

    Установлено, что рыболовецкое судно «Сейс-1», прибывшее из г. Ейск Краснодарского края, в связи с поломкой пришвартовалось в морском порту Туапсе. Неисправному судну было отказано в разрешении на выход из порта в связи с неисправностью главного двигателя, но, несмотря на запрет и не выполнив законное распоряжение капитана порта, судно вышло в море, за что органами Ространснадзора капитан был привлечен к административной ответственности по ч. 1 ст. 11.8 КоАП РФ.

    При этом неповиновение законному распоряжению или требованию должностного лица органа, осуществляющего государственный надзор (в том числе капитана порта), образует состав административного правонарушения, предусмотренного ч. 1 ст. 19.4 КоАП РФ.

    Туапсинским транспортным прокурором по результатам проверки вынесено постановление о привлечении капитана рыболовецкого судна к административной ответственности, предусмотренной ч. 1 ст. 19.4 КоАП РФ, мировым судьей судебного участка №110 города Туапсе виновный привлечен к ответственности, ему назначено наказание в виде административного штрафа в размере 2 тыс. руб.

    Постановление в законную силу не вступило.
