    С капитана судна «Вирил» (флаг Белиз) взыщут 5,6 млн руб. за браконьерский промысел краба у берегов Камчатки

    На Камчатке суд не изменил решение о взыскании 5,6 млн руб. с осуждённого капитана браконьерского судна, сообщает пресс-служба прокуратуры Камчатского края.

    В марте 2018 года приговором Петропавловск-Камчатского городского суда Камчатского края капитан иностранного судна «Вирил» 54-летний житель Республики Крым Григорий Гвоздёв осуждён по ч. 2 ст. 253 УК РФ (разработка природных ресурсов исключительной экономической зоны Российской Федерации, проводимая без соответствующего разрешения) и ч. 2 ст. 201 УК (злоупотребление полномочиями, повлекшее тяжкие последствия).

    В суде установлено, что на указанном судне, принадлежащем иностранной компании «Норд Карго Сервис С.А.» (государство Белиз, порт приписки Республика Того), в январе 2017 года, находясь в Беринговом море, в исключительной экономической зоне РФ, под руководством Гвоздёва экипаж судна вел незаконный промысел краба.

    В момент задержания траулера на его борту без разрешительных документов хранилось и транспортировалось 13 490 особей краба синего в живом виде. Промысловая документация на судне не велась, технические средства контроля отсутствовали, в контролирующие органы суточные донесения капитан не подавал и намеренно обходил контрольные точки.

    После задержания судна-нарушителя весь живой краб пограничниками выпущен в естественную среду обитания, 85 особей погибло. С учетом этого ущерб водным биоресурсам Российской Федерации составил 5 млн 667 тыс. руб.

    В рамках административного производства, проведенного в отношении иностранной компании, браконьерское судно конфисковано.

    Суд приговорил Гвоздёва к трем годам лишения свободы с отбыванием в колонии общего режима со штрафом 300 тыс. руб. и лишением права занимать должности капитана добывающих, перерабатывающих и транспортных судов на два года. Камчатский краевой суд отклонил апелляционную жалобу осужденного, приговор оставлен без изменения.

    После вступления приговора в законную силу Камчатская межрайонная природоохранная прокуратура направила в суд иск о взыскании с капитана ущерба, причиненного преступлением.

    В январе 2019 года заочным решением Белогорского районного суда Республики Крым исковые требования прокурора удовлетворены в полном объеме.

    Не согласившись с решением, признавая, что причинил ущерб только на 71 тыс. руб., на основании статьи 237 Гражданского процессуального кодекса РФ ответчик обжаловал его, заочное решение отменено. Гражданское дело повторно рассмотрено районным судом уже в открытом судебном заседании в общем порядке.

    Решением от 23 июля 2019 года Белогорский районный суд оставил сумму взысканного ущерба без изменения. Решение не вступило в законную силу.
