The Court rules to recover more than $19.000 from Astrakhan fuel company in favor Akhtuba Shipping

The Twelfth Arbitration Court of Appeal upheld the decision of the Arbitration Court of Astrakhan region, to recover from Fuel Company AstrakhanTopProm 566.6 thousand rubles of debt and surcharge in favor of Akhtuba Shipping Company, Astrakhan FM reports.
 
According to the record of court, in 2008 the two parties signed a contract for the supply of coal products. According to the agreement Akhtuba Shipping Company “turned over to AstrakhanTopProm 238 tons of coal worth 476.6 thousand rubles. The buyer who received the goods did not pay, that was grounds for the seller to apply to the Arbitration Court of Astrakhan region with a claim for recovery of 476.6 thousand rubles of debt and 178 thousand rubles of surcharge”.

The trial court had granted the plaintiff's claims in part, to recover the amount of principal and 90 thousand rubles of surcharge. Disagreed with the decision, AstrakhanTopProm challenged it at the Twelfth Court of Appeal.

Having investigated the case materials, the Arbitration Court of Appeal found the court’s decision was legal and grounded.
