Russian Association of Bunker Suppliers litigates the ban on off-harbour bunkering
Selfregulating organization Russian Association of Marine and River Bunker Suppliers (Rosmorrechbunker) has applied to the Moscow City Arbitration Court for cancellation of the teletypogram of the Central Energy Customs chief P. Strelnikov (No 01-17/6123 dated 22.08.2013), IAA PortNews learnt from the Association.
This document prescribes that goods declared as supplies (ship fuel) should be cleared only at the berths of specialized oil terminals (with the exception of Russian seaports without specialized oil terminals).
Russian Association of Marine and River Bunker Suppliers thinks that the Customs instructions are in direct contradiction with the Convention on Facilitation of International Maritime Traffic, International Convention on the Simplification and Harmonization of Customs Procedures, Customs Code of the Customs Union and other laws and regulations of the current customs legislation. Actually, this does not “facilitate foreign trade of the Russian Federation or contribute to the development of foreign economic ties of RF constituent entities or faster turnover of goods”, as it is set forth by clause 1 of Article 12 of the Federal Law On Customs Regulation in the Russian Federation, Rosmorrechbunker beleives.
Moreover, the bunkering companies are sure that this ban hinders the development of domestic seaports and considerably decreases their attractiveness as compared with neighboring foreign ports. That is why, the Association Board decided to apply both to the Federal Antimonopoly service, the Ministry of Transport, the General Prosecutor Office and the Arbitration Court.
