Abolishment of phytosanitary control at customs

On September 29, 2009, the Federal Customs Service of the Russian Federation (FCS) provided a proof on fulfillment of the order of the Federal Antimonopoly Service (FAS of the RF) related to introduction by the customs and the Federal Agency for Vetirinary and Pytosanitary Supervision (RosSelkhozNadzor) of a “List of goods subject to state phytosanitary quarantine control”, FAS press center reports.

“FCS has officially noticed FAS on revocation of the above list by the Decree N1775 dated September 29, 2009,” the report states.

 

On August 28, 2009, FAS acknowledged FCS and RosSelkhozNadzor to be violators of antimonopoly legislation forbidding authorities’ activities restraining competition (clause 2, part 1, article 15 of anti-competition law).

 

The matter related to introduction of a “List of goods subject to state phytosanitary quarantine control” by the customs and RosSelkhozNadzor. The document regulating additional customs control was approved by FCS and RosSelkhozNadzor on May 27, 2009. According to the document, the above goods entering the territory of the Russian Federation are subject to obligatory state phytosanitary quarantine control including inspection at the border checkpoints.

Having considered the case, FAS acknowledged RosSelkhozNadzor to have been not entitled to elaborate or to approve such a list and FCS to have approved the document elaborated with violation of the legislation. 

According to FAS, those illegal acts restrained activities of business entities with requirements not provisioned by the legislation.

The document was ruled illegal. FCS and RosSelkhozNadzor were ordered to eliminate the violation.
