Ob-Irtysh River Shipping Company suing out RUR 80 mln from Temryukmortrans (general forwarder of Gazprom)
Ob-Irtysh River Shipping Company OJSC (Khanty-Mansyisk) is suing out RUR 79,749,337.51 from a general forwarder of Gazprom OJSC - Temryukmortrans LLC, PortNews IAA learnt from Evgeni Kormyshov, Director General of Mezhregionflot LLC (managing organization of Ob-Irtysh River Shipping Company). The case is being considered by the Arbitrage Court of the Krasnodar region from September 2011.
According to the source, in 2010, Temryukmortrans LLC signed a contract with Ob-Irtysh River Shipping Company OJSC for transportation of cargo for the construction of a compressor station and a pipeline in Bovanenkovo village (Yamal peninsula). Having completed the work in full in navigation of 2010 the shipping company did not receive the payment under the contract and turned to the court.
“Director General of Temryukmortrans LLC tried to make the contract, the guarantee letters and the work acceptance statements to be invalid,” Kormyshov explained.
The court of first instance rejected the suit in January 2012, the second instance gave judgment in favour of Ob-Irtysh River Shipping Company OJSC on May 10, 2012 resolving to collect the debt of RUR 66.3 and penalty of RUR 13.5 mln, as well as to cover court costs of RUR 200,000.
The executory process started on June 14, 2012 was suspended on July 26, 2012 by FAS. With the complaint of Ob-Irtysh River Shipping Company OJSC the case was remitted for a new trial in the Arbitrage Court of the Krasnodar region.
The court of first instance gave the judgment in favour of Ob-Irtysh River Shipping Company but the decision was appealed by Temryukmortrans on February 4, 2013.
The scheduled meeting of the 15th appeal court will be held on March 13, 2013.
Ob-Irtysh River Shipping Company OJSC provides services on transportation of cargoes and delivery of construction materials for the enterprises of Yamal-Nenets autonomous region, Khanty-Mansyisk autonomous region, south of the Tyumen region, Far North and the Caspian Basin.
