The Court ordered Terminal Astafiev OJSC prevent or reduce hazardous emissions

The inspection carried out by the Prosecutor’s Office  in respect of the activities of Terminal Astafiev OJSC (Nakhodka) revealed violations of the environmental legislation. According to the press center of the Far East Prosecutor’s Office, the Court decided in favour of the Prosecutor.

It was revealed that the company executing coal transshipment at the port has fixed sources of environmental pollution but does not undertake any dust control measures. The plan of environmental activities approved by the company is not fulfilled.

In order to rectify the discovered violations, Transport Prosecutor of Nakhodka filed a petition in the Nakhodka City Court of the Primorsk Territory, and the Court upheld the claims in full. According to the Court’s decision, when performing loading/unloading of coal the company should carry out activities focused on collection/ disposal/ management of hazardous (polluting) emissions in order to prevent or reduce such emissions.

The Court's judgement has not gained the legal effect yet.

Terminal Astafiev OJSC was set up to coordinate the activities of railways and seaborne transport. It will execute the function of a port fleet in Nakhodka Bay. Coal transshipment will be performed at the existing transshipment facilities of Terminal Astafiev established in 2011. With the terminal modernization, its throughput was gradually increased to 1 mln t in 2014, 1.5 mln t in 2015 and 2.1 mln t in 2016 год. The project on Terminal Astafiev modernization has been under implementation from 2012.
