Appeal of Baltic Basin Response Department (BBRD, St. Petersburg) against the ruling of Arbitrage Court of St. Petersburg and Leningrad region dated 16.02.07 on the right of lease of berth No 94 in the port of St. Petersburg was satisfied by the 13th Arbitrage Court of Appeal on May 8 2007. As PortNews IAA learnt from Leonid Khasiev, acting Director General of BBRD, the Court invalidated the agreement on lease of the berth by stevedoring company Delta-Service LLC. In particular, the Court's decision implies compelling of Delta-Service LLC to return the berth to BBRD. Under Russian legislation, the Court’s ruling comes into effect immediately. Thus, upon execution of the court’s written document (usually it takes five days after the sitting), Delta-Service LLC is obliged to remove its equipment from the berth and lead the tanker away, Khasiev said. Pavel Geiner, Director General of Delta-Service LLC told PortNews IAA the company intends to submit a cassation appeal. “We do not agree with the Court’s ruling but our company will not violate Russian legislation.” In 2005, Delta-Service LLC signed an agreement with BBRD for a 10-year long lease of the berth No 94. The berth No94 is at to the balance of BBRD on the basis of economic control rights. The berth is used for export transshipment of oil products and bunkering of vessels. In 2006, 455.9 thou tons of product was handled at the berth.
