The Arbitration Court of Appeal of the Primorsky Territory on November 22, 2012 ruled that Pacifico Marine, Ltd. can take its newbuilt catamaran "Vladivostok" and other property from the yards of Vladivostok-based Vostochnaya Verf Shipyard. The decision will come into force five days after the hearing.
"After the four-month siege of our property by Vostochnaya Shipyard we have finally the judicial decision that would allow us to take our own catamaran, get her launched, and subsequently deliver the ship to the Customer," says Pacifico Marine CEO Sergei Voloshenko.
Pacific Marine Ltd. said that because of the illegal actions of the management of Vostochnaya Shipyard has borne huge unnecessary losses, its property has been substantially damaged.
"We will seek to recover all expenses caused by the actions of the shipyard and return to normal activity of Pacifico Marine," said Voloshenko.
Pacific Marine was executing a turnkey contract for one of a package of three passenger catamarans, which were ordered for the APEC-2012 Summit in Vladivostok, and was forming a hull of the second vessel of the series. The company was building the boat on the yard leased from Vostochnaya Shipyard, which itself was also performing a contract for two catamarans of the series.
The cost of each boat is about RUB 100 million. Pacifico Marine built the third catamaran "Vladivostok" for seven months but Vostochnaya Shipyard authorities did not allow the shipbuilding firm to transport the boat on its territory (200 meters to the water) prohibited access of Pacifico Marine personnel to the yard.
