The amendments relate to the financial security of seafarers in cases of abandonment (Reg 2.5), and contractual claims for compensation in the event of a seafarer's death or long-term disability due to an occupational injury, illness or hazard (Reg 4.2). A copy of the 2014 MLC amendments is available on the ILO's website. Norwegian regulations implementing the amendments will enter into force on the same date.
As of 18 January 2017, each ship must carry on board documentary evidence of financial security to comply with these new provisions.
Information regarding the contents of the certificate or other documentary evidence is provided in the new Appendix A2-1 and A4-1.
The amendments to the Convention shall also be reflected in the Maritime Labour Certificate. The deadline for getting this into place is by the ship's next MLC renewal inspection due after 18 January 2017. The NMA will issue a new DMLC Part 1 upon request from the company prior to the ship's next scheduled MLC inspection after 18 January 2017.
Shipowners should amend the DMLC Part II once the flag State has re-issued the DMLC part I to address these new MLC provisions. This should be done at the earliest opportunity, but no later than the first renewal MLC inspection due after 18 January 2017, at which time these new provisions will be verified.
