Rosmorport demands termination of rent agreement with Nakhodka TSP over its noncompliance with obligations
FSUE Rosmorport has applied to the Arbitration Court of the Primorsky Territory to institute proceedings against Nakhodka Trade Sea Port for termination of an agreement on renting of berths “due to noncompliance with obligations under environmental regulations of the Russian Federation”, Rosmorport told IAA PortNews.
“The control of lessee’s compliance with watchdogs’ requirements revealed long and systematic violation of environmental and sanitation-and-epidemiological regulations of the Russian Federation. In particular, Nakhodka TSP received but failed to comply with two prescriptions of Rosmorport’s Pacific Branch to equip the territory of Nakhodka TSP with facilities ensuring protection of Nakhodka Bay from contamination, pollution and setting of sludge caused by waste water. Amid violation of sanitation-and-epidemiological regulations, Nakhodka TSP was also given a prescription by Rospotrebnadzor’s Primorsky Territory Branch.
Besides, there is a valid judgment of Nakhodka City Court over a claim of Nakhodka Transport Prosecutor on obliging the company to undertake measures on collection and disposal of hazardous substances entering the air during loading/unloading operations, reduction and elimination of such emissions”, says Rosmorport.
The application does not contain any claims for compensation.
Nakhodka Trade Sea Port is a stevedore company, operator of a terminal in the eastern Gulf of Peter the Great, in the Nakhodka Bay (Primorsky Territory). The port is able to handle up to 580 railcars per day. Warehousing facilities area is 300,000 square meters.
