For violation of the country’s law on the state border at the anchorage locations in the Gulf of Finland as from July 22 through the present, 24 ship masters were called to administrative accounts and fined RUB 700 000, the FSB’s Border Administration press office said.
The department noted that the rules for sailing of Russian and foreign flagged vessels from the state border of the Russian Federation to the state border checkpoints and vice versa are established by Article 9 of the Law of the Russian Federation dated April 1, 1993 (No. 4730-I) “On the State Border of the Russian Federation”.
The boundary limits of the permanent marine cargo and passenger border crossing point in the seaport of Ust-Luga were established by order of the Ministry of Transport of the Russian Federation as of May 4, 2018. (No. 178).
In addition, Art. 13 and Art. 14 of the Federal Law of the Russian Federation dated November 8, 2007 (No. 261-FZ) “On Seaports in the Russian Federation and Amending Certain Legislative Acts of the Russian Federation”, it is determined that the rules for moorings at seaports and on access channels are established by the “General Rules for Navigation and Moorings at Sea Ports of the Russian Federation and on the approaches to them”(approved by order of the Ministry of Transport No. 463 dated October 25, 2017) and specified by “Mandatory Regulations in the Seaport of Ust-Luga” (approved by order of the Ministry of Transport, January 15, 2013 № 6).
The anchorage areas of the seaport of Ust-Luga are defined in Appendix 4 to the “Mandatory Regulations in the Seaport of Ust-Luga” (approved by Order No. 6 of the Ministry of Transport of the Russian Federation of January 15, 2013). The appendix contains an exhaustive list of anchorage sites of the port of Ust-Luga. Anchorage No. 10a is absent there, as it is absent in other Obligatory Ordinances for ports located in the Russian part of the Gulf of Finland.
Also Art. 5 of the Federal Law of the Russian Federation of July 31, 1998 “On Inland Sea Waters, the Territorial Sea and the Adjacent Zone of the Russian Federation”, the legal regime of seaports of the Russian Federation is determined, as well as the fact that the official regulating the entry of vessels into the seaport and the exit of vessels seaport, is the captain of the seaport, and Art. Section 6 of the federal law defines the requirements for calling foreign ships at seaports, including the obligation to comply with border, customs and other rules established by laws and other legal acts of the Russian Federation.
