Ukrainian court’s ruling puts an end to the dispute between SCPI and UKRTRANSCONTAINER

The Supreme Economic Court of Ukraine on Dec. 29, 2010 upheld the appeals of Prosecutor's Office, Ministry of Transport, SE Ilyichevsk Commercial Sea port (SCPI), the SCPI’s Trade Unions, announcing its final decision on the long-standing dispute between SCPI and private enterprise UKRTRANSCONTAINER terminating joint activities contract № 435, the SCPI’s press service said.

"Thus, in its decision the Supreme Economic Court of Ukraine dismissed the UKRTRANSCONTAINER’s appeal to reopen the case on newly discovered evidence and upheld the ruling of the first two courts - the Economic Court of Odessa region (May 12, 2009) and Odessa Economic Court of Appeal (June 26, 2009), as well as the decision of Ukraine's Supreme Court (Nov. 3, 2009), that the contract was terminated due to substantial violations of its terms and conditions by UKRTRANSCONTAINER," the Ilyichevsk port’s statement said.

Private enterprise UKRTRANSCONTAINER (UTC) has been the container terminal operator at the port of Ilyichevsk from August 1, 2005. UTC is part of the National Container Company, Russia's largest operator of container terminals. The company completed on Nov.16, 2007 the first phase of the investment program ‘4 M’, boosting the container terminal capacity to 850,000 TEUs. The program investment totaled $ 61 million. The terminal is handling cargoes of the world's leading shipping lines: Maersk Line, MSC, CMA CGM, K-Line, ZIM, China Shipping, Economou-CSAV Norasia, Whan Hai, PIL, Yang Ming, Cosco, Evergreen.
