President Yushchenko cancels government’s decrees on Octyabrsky and Nikolaev ports

Ukrainian President Viktor Yushchenko has suspended this fall’s decrees of Cabinet of Ministers of Ukraine concerning the lending the state-run Oktyabrsky and Nikolaevsky seaports of the harborage territories. Obtaining these areas by the two ports, presidential office press service said, violated the Constitution of Ukraine. In this regard, the effect of these decrees has been suspended by the President since December 21.
These decisions of the Cabinet of Ministers of Ukraine were not agreed with local authorities, as required by the first part of article 12 of the Merchant Shipping Code of Ukraine.
As a result, last year's Cabinet decision allowed the ports to add coastal areas and land plots adjacent to the harborage area, which had been landed to or in use by other property owners, the document said.
As to the same decision of the Cabinet concerning Nikolaev Sea Commercial Port, the decision allowed the port to add transit waterways.
"Because of such decision the state enterprise Nikolayev Commercial Sea Port seized waterway intended for transit shipping, destroying its integrity. That has led to domination of these companies on the market of specialized stevedore port services and opportunity to abuse this situation, improper management of the waterway and restricting other business entities the ability to carry out trans-shipment on the trading ships of over 50 thousand tons ", the official document reads.
