Business court in Odessa region (Ukraine) rejected Moebius claim to SCPI and EBRD

The Business Court of Odessa region declined the security of suit previously applied to Sea Commercial Port of Ilychevsk (SCPI, Ukraine) prohibiting arrangement of any activities under the loan project with the European Bank for Reconstruction and Development (EBRD). This decision was made on March, 26 at the regular meeting of the court, the press service of the port reports. Suit against SCPI and EBRD was brought by Moebius Construction Ukraine Ltd (a subsidiary of German company Josef Moebius Bau-Aktiengeselschaft).

Enterprise statement says, Moebius Construction Ukraine Ltd. did not prequalify in October, 2009 and was not allowed to participate in the tender for reconstruction of three berths (N7,8, 9) under the loan agreement with EBRD and SCPI to the sum of 26 million euros.

Reportedly, despite all the efforts by Moebius Construction Ukraine Ltd, SCPI representatives managed to prove convincingly that the organized open international tender  to chose a contractor company meets all international requirements, procedures of EBRD and FIDIC.
