This Federal Act ratifies the Agreement on the establishment and implementation in the Customs Union countries of the order of enrollment and distribution of customs duties (other duties, taxes and charges with equivalent effect), signed in St. Petersburg on May 20, 2010.
The agreement provides the definition of the order of including and distribution between the Republic of Belarus, Kazakhstan and the Russian Federation amounts of customs duties, the obligation to pay that in respect of goods imported into the customs territory of the Customs Union, is effective from the date of the first application of the established agreement on the including and distribution of customs duties in accordance with the decision of the Commission of the Customs Union.
The Agreement also contains provisions governing the relationship of the parties with failure to transfer or partial transfer of funds.
In addition, the Agreement provides for an annual audit by the State Control Committee of Belarus, the Accounts Committee for control over execution of the republican budget of the Republic of Kazakhstan and the Russian Federation Accounts Chamber of compliance with the authorized bodies of the parties of the Agreement.
According to the document, import customs duties shall be payable in local currency to the account of single competent authority of the party, in which they are due in accordance with customs legislation of the Customs Union. Normative distribution of amounts of import customs duties for each party are set in the following amount: Belarus - 4,7%, Kazakhstan - 7.33%, Russia - 87.97% of customs duties on a single account of the authorized body.
